Website Maintenance Agreement Disclaimer
- 1. Additional Services & Costs: Additional services or costs that arise from extraordinary circumstances that are outside the scope of the standard maintenance agreement will be subject to an additional fee billed at $150.00 per hour. Such circumstances may include but are not limited to, unexpected system failures, unique customization requirements, extensive changes or additions to the website’s content, design or structure.
- 2. Notification & Separate Agreement: Prior to undertaking any changes or additional services that require an extra fee, the client with be notified and a separate agreement will be made. This separate agreement will be distinct and independent of the existing maintenance agreement and must be executed before any such additional services are provided.
- 3. Maintenance of Older Websites: Websites older than 5 years from the date of this agreement will no longer be eligible for maintenance under the terms of any pre-existing maintenance agreement. If maintenance of an older website is required, a new and specific agreement must be made to fit the unique needs and requirements of that older website. Any existing maintenance agreements do not apply to websites older than the 5-year threshold, unless expressly provided for in a separate agreement that is tailored to the older website.
- 4. General IT Services: While IT services are part of the offerings from Impact Marketing, there are certain exceptions within this agreement. Should the client require support for issues beyond the scope of Impact Marketing’s standard IT services, such needs can be addresses separately. However, please note that Impact Marketing cannot guarantee support for matters that fall outside of the specified services. These exceptions may encompass but are not limited to:
- 1. Impact Marketing provides email support specifically for Outlook, Office365 and Webmail. Any support or services that fall outside of this defined scope will not be covered under the existing maintenance agreement.
- 2. Continuous, around-the-clock technical support or emergency IT assistance is NOT available through our standard packages.
- 3. Ensuring compliance with specific legal regulations, industry standards or certifications (e.g., HIPAA, GDPR) is NOT a service we provide.
- 4. Support for physical hardware, encompassing third-party servers, computers, phone assistance or network equipment falls outside of our area of expertise and is NOT included in our services.
By engaging in the maintenance services provided under this agreement, the client acknowledges and agrees to the above terms. Failure to comply with these terms may result in additional charges, termination of services or other legal remedies as allowed by law.
